1. By placing a commission, making payment, or approving a quote, you confirm that you have read and agree to these Terms of Service.
2. HappyPixels Art may update these terms when needed. Updated terms apply to new orders only. Existing commissions will follow the terms agreed to when the order was accepted.
3. HappyPixels Art may decline, cancel, or refund any request that is outside the artist's comfort level, availability, or ability to complete. If the artist cancels an order after payment, the refund policy in Section 7 applies.
4. Prices, availability, and commission openings may change without notice. A confirmed and paid order keeps the quoted price unless the client requests changes outside the original scope.

• Fan art
• Anime and game characters
• Kemonomimi art
• NSFW artwork for verified adults aged 18 or older

I will not draw

• Offensive, hateful, discriminatory, or harassing content
• Mecha
• Requests that include AI-generated images or AI-generated references
• Religious, political, or other non-neutral topics
• Anything illegal, exploitative, or otherwise outside my comfort level

This list is not exhaustive. I may decline any request at my discretion.

1. Commission requests may be made through any commission platform I am active on, by email at Happypixels.art@gmail.com, or through a contact method I have publicly provided on my social media.
2. Please include the commission type, character references, desired pose or expression, outfit details, background preferences, deadline if any, and any important notes.
3. Clear visual references are strongly preferred. Written descriptions can supplement references, but unclear or incomplete information may affect the result or require paid changes later.
4. AI-generated images, AI-generated reference sheets, and AI-assisted image references are not accepted. Please provide official, commissioned, drawn, photographed, or otherwise non-AI references.
5. Let me know before ordering if you would like creative freedom. If creative freedom is given, design and composition choices are left to the artist and are not grounds for a full redraw.
6. A request is not confirmed until I accept it and payment or the required deposit has been received.

1. All prices are in EUR (€) and are for digital artwork only.
2. Payment is accepted through the commission platform used for the order or another method agreed upon between the client and the artist.
3. For every commission, a 50% deposit is required before work begins. The remaining 50% is due after the artwork is finished, before the final high-resolution file is delivered.
4. Payment requests must be completed within the stated invoice or platform deadline. Unpaid requests may be cancelled and the slot may be offered to someone else.
5. Payment processing fees, currency conversion fees, and any fees charged by the chosen platform are the client's responsibility where applicable.
6. Do not send payment until your request has been accepted or a payment link has been provided.

1. Typical turnaround is approximately 1 week to 1 month from the start of work. This is an estimate, not a guaranteed delivery date.
2. Timing can vary based on commission complexity, queue position, revisions, health, personal circumstances, technical issues, and client response time.
3. If a significant delay occurs, I will communicate it as soon as reasonably possible.
4. Any deadline must be disclosed before ordering. I may decline a short deadline if it cannot be completed responsibly.
5. Rush commissions may be available for an additional fee. Rush availability and the fee must be agreed upon before payment. A deadline mentioned after work begins is not automatically accepted as a rush order.
6. The commission timeline pauses while I am waiting for required information, payment, revision feedback, or approval from the client.

1. A work-in-progress preview will normally be sent at the sketch stage. Additional updates may be provided at my discretion or when the commission type requires them.
2. Each commission includes up to 3 free revision rounds during the sketch stage. Please review the sketch carefully before approving it.
3. A minor revision is a small adjustment, such as a simple color correction, small accessory change, or minor detail correction. A major revision includes changes to pose, composition, character design, outfit, expression, or other substantial elements.
4. Major changes should be requested at the sketch stage. After sketch approval, changes may be limited, declined, or charged depending on the amount of work required.
5. Changes requested after lineart, coloring, or rendering begins may require an additional fee. A full redraw after sketch approval is treated as a new or substantially revised commission.
6. Corrections for mistakes caused by the artist, where the detail was clearly provided in the approved reference or written brief, will always be fixed free of charge.
7. Changes caused by unclear, missing, changed, or newly supplied client references may be charged.

1. If you need to cancel, contact me directly as soon as possible. Refunds are based on the stage of work completed when the cancellation request is received.
2. Refund amounts for client cancellations are as follows:
   • Before work starts: 100% refund
   • During the sketch stage: 70% refund
   • During lineart: 50% refund
   • During coloring or flats: 30% refund
   • During rendering or shading, or after completion: no refund
3. The applicable stage is determined by the work completed, not only by whether a WIP has been sent.
4. If I must cancel because I cannot complete the commission, I will issue a full refund of all payments received for the unfinished commission.
5. No final file will be delivered until the remaining balance is paid. The refund amount, if any, is limited to the amount actually paid after accounting for the applicable completed-work stage.
6. Completed, delivered, or substantially completed work is not refundable. This policy does not affect corrections for artist errors under Section 6.

1. Finished commissions are delivered as high-resolution PNG files through the agreed platform, email, or a download link.
2. Commissions are digital products. No physical item will be shipped unless explicitly agreed in writing.
3. PSD files, source files, raw files, and layered files are not included unless discussed and priced separately before work begins.
4. Please download and back up final files promptly. I will make reasonable efforts to help with re-sending files, but long-term file storage is not guaranteed.
5. For split-payment orders, a watermarked or preview file may be provided before the remaining balance is paid. The final unwatermarked, high-resolution file is delivered after full payment.

1. HappyPixels Art retains full copyright and all intellectual-property rights to the artwork, including the right to display it in portfolios, commission examples, social media, and promotional materials.
2. The client receives a non-exclusive, non-transferable personal-use license for the finished commissioned artwork after full payment.
3. Personal use includes using the artwork as a profile picture, banner, wallpaper, personal social-media post, or personal print, provided the work is credited when posted.
4. Please credit HappyPixels Art when sharing the artwork publicly. You may link to Bluesky or tag @HappyPixels.Art on Instagram where practical.
5. You may claim ownership of your character, but not authorship of the artwork itself.
6. Do not remove, obscure, crop out, or alter a watermark or signature. Do not edit the artwork without permission, except for ordinary display cropping that does not remove credit or materially change the work.

1. Commissions are for personal use only unless a commercial license is agreed upon in writing before ordering.
2. Commercial use includes, but is not limited to, monetized content, streaming assets, advertisements, business branding, merchandise, games, paid publications, and any use that directly or indirectly generates income.
3. Commercial licensing may be available for an additional fee, generally 50% to 100% of the base commission price, depending on the intended use, reach, exclusivity, and scope.
4. Commercial permission is limited to the specific use agreed upon. It does not transfer copyright, grant ownership of the artwork, or automatically allow merchandise, resale, sublicensing, editing, or use in unrelated projects.
5. Please discuss commercial plans before ordering so the correct quote and license can be arranged.

The following are not allowed without exception or written permission where applicable:

1. Using the artwork for AI training, AI generation, dataset creation, model fine-tuning, image-to-image generation, scraping, or any similar automated system.
2. Minting, selling, listing, promoting, or associating the artwork with NFTs, cryptocurrency, blockchain projects, or tokenized assets.
3. Reselling, redistributing, sublicensing, uploading as a stock asset, or giving the artwork to others for commercial use.
4. Claiming authorship of the artwork or implying that it was created by anyone other than HappyPixels Art.
5. Tracing, heavily editing, recoloring, modifying, or creating derivatives from the artwork without prior permission.
6. Removing watermarks, signatures, or credit.
7. Using the work in hateful, illegal, exploitative, or otherwise harmful contexts.

Violation of these restrictions may result in loss of usage rights, refusal of future service, a blacklist, and further action where necessary to protect the artwork.

1. I may share sketches, WIPs, and finished commissions on my social media, portfolio, commission pages, and promotional materials.
2. Private, gift, or surprise commissions can be arranged if requested before ordering. Please provide any relevant reveal date or posting restrictions.
3. An NDA or full confidentiality arrangement may be available for an additional fee. It must be discussed and agreed to before payment and before work begins.
4. If privacy has been agreed, both parties should respect the agreed posting restrictions. Once the client publicly shares a private commission, I may treat the work as cleared for portfolio or social-media posting unless a separate written agreement says otherwise.

1. NSFW commissions are available only to clients who are at least 18 years old and legally adults in their place of residence.
2. By requesting NSFW artwork, you confirm that you are 18 or older. I may request age verification when necessary and may decline the request if age cannot be confirmed.
3. Misrepresenting your age, attempting to commission NSFW work while underage, or providing NSFW material involving minors will result in immediate cancellation, blacklist, and any further action required for safety and legal compliance.
4. NSFW content will only be posted on age-restricted or adult-appropriate platforms, when it is posted at all.
5. I may decline any NSFW request for any reason, including content that is illegal, unsafe, exploitative, or outside my personal boundaries.

1. Please keep communication clear, respectful, and focused on the commission. Harassment, threats, abusive language, repeated pressure, or disrespectful behavior may result in cancellation and a blacklist.
2. Clients should respond to WIPs, approval requests, and important questions within 48 hours when possible.
3. If no response is received for more than 2 weeks, the commission will be paused until the client returns. The timeline will be extended by the period of non-response.
4. If no response is received for 1 month after a reasonable contact attempt, the commission may be considered abandoned. No refund is due for completed work or work already performed. Any remaining refund will follow the stage-based policy in Section 7. In the case of abandonment, I reserve the right to repurpose the concept, pose, composition, or design of the artwork for other projects. If the commission features the client's original character, that character will not be reused, but the overall concept and creative work may be adapted with a different character.
5. Clients are responsible for providing accurate references, confirming important details, checking WIPs, and saving delivered files.
6. Repeatedly requesting updates, pressuring for work outside the agreed timeline, or changing the brief repeatedly may delay the commission, incur additional fees, or lead to cancellation where appropriate.

1. If there is a problem with your commission, please contact me directly first. I will make a good-faith effort to resolve genuine concerns through communication, corrections, or the applicable refund policy.
2. Do not file a chargeback, payment dispute, or unauthorized payment reversal for work that has been started, delivered, or addressed under these terms.
3. If a chargeback or dispute is filed without first attempting to resolve the issue directly, I may provide the payment platform with commission messages, invoices, WIPs, delivery records, and these terms as evidence.
4. Unauthorized chargebacks or bad-faith disputes may result in a blacklist and immediate loss of any license or permission to use the artwork, to the extent permitted by law.
5. This section does not prevent a client from using payment-platform protections where legally required or where there is a genuine unresolved issue. It asks that direct communication be attempted first whenever possible.

1. These Terms of Service may be updated from time to time to reflect changes to my process, services, or applicable requirements.
2. The version in effect when an order is accepted applies to that commission, unless both the client and HappyPixels Art agree in writing to a change.
3. New or updated terms apply to future orders only.
